Contract/Agreements
Session Fees
Client agrees to pay photographer the couple family session fee of $440. Client agrees to pay photographer a non-refundable retainer of $100 at the time of booking to secure their appointment date and time. The remaining balance will be due the day of your scheduled photoshoot with cash, through Zelle, or check. The check can be written out to Jinely Reyes Photography. The $440 covers the time and talent of photographer, basic retouching and creative editing of images as determined by the photographer, up to 1 outfit change, family of 9 or less, and 25+ images available for download through an online gallery. Client agrees to pay any extra charges a venue may charge if scheduled on their site. Note - photo sessions do not include images on a USB-drive. Please allow up to 2-3 weeks for delivery of the images through an online gallery.
Rescheduling
Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
Re-shoots / Refunds / Cancellation
Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair, child behavior, or by not following the recommendations of the photographer. No refunds will be given. Client has 2 months from the date of cancellation to re-schedule a new photo session date. If client fails to re-schedule within that time frame they will forfeit their $100 non-refundable retainer. Client can only re-schedule up to one time. After the first re-schedule, retainer becomes a cancellation fee. In case of inclement weather, Client and Photographer must agree on a re-shoot date. Fourty-eight hours notice of postponement or cancellation is appreciated to ensure the $100 retainer can still be redeemable.
Archive
After 14 days, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
Payment
All payments are due in full unless payment arrangements have been made. Edited images will not be processed and sent until payment in full is received.
Model Release
I hereby give to Jinely Reyes Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:
a) To copyright the same in the photographer’s name or any other name that he/she may select;
b) I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs.
Photographer retains all copyrights to the products produced and therefore reserves the right to use any portion thereof for advertising, display, internet promotion, publication and other purposes.
Shooting and Editing Style
The Client understands that the photographer is hired based on their style of shooting and editing, and as such the final piece is considered a commissioned product. Therefore, the client allows Photographer the freedom to work in their chosen style and allows the photographer the freedom to make shooting and final editing decisions based on the availability of useable images and the flow of the final edited product. Photographer reserves the right to delete or discard images deemed unusable either before or after editing has occurred.
Edited Images
Photographer agrees to edit the best images taken at their own discretion. Photographer will filter through the images taken and will not edit images we do not deem worthy of additional time and effort. Photographer agrees to edit all images we feel are of value and importance.
Print Release Policy
Client has full printing rights to edited images.
Indemnity and Release of Liability
Client agrees to indemnify Photographer and hold Photographer harmless from all claims, demands and liabilities, including costs and attorney’s fees, to Photographer is subjected by reason of any action by Client taken or omitted pursuant to this Agreement. Client shall indemnify Photographer against any and all claims arising from any injuries that may occur during a Photography session. Client understands that Photography sessions may be held outdoors and that natural hazards may exist. Client agrees that Photographer shall not be responsible for any injuries occurred during a Photography session and waives any claims against Photographer should such injuries occur.
Force Majeure
If (a) Photographer is unable to perform its obligations under this Agreement due to fire or other casualty, act of God, or any other cause beyond the reasonable control of Photographer, or (b) if the photographic materials are damaged in processing, lost through camera malfunction or otherwise lost or damaged, then Photographer shall refund any payments, except for the reservation fee, made by the Client and shall have no further liability with respect to this Agreement. In any event, Photographer shall not be liable for any damages, direct or otherwise, for any amount in excess of amounts paid by the Client to Photographer hereunder. Additionally, Photographer reserves the right to refuse to shoot in any conditions that could compromise the safety of the photographer, the equipment or anyone else involved in the production.
Substitute Photographer
Photographer reserves the right to substitute with another photographer, should extenuating circumstances necessitate the need for substitution. The substitute photographer will be chosen at Photographer’s discretion and does not constitute a breach of this agreement. Photographer warrants the substitute photographer to be of comparable quality, style, and professionalism. Should client choose not to accept the photographers offered by Photographer prior to the date, please refer to Force Majeure.
Session Requests
*No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer.
*Session starts at the agreed upon time. It is strongly encouraged that client arrives 10-15 minutes prior to the start of session. This allows for any last-minute changing and relaxing before session begins. In the event that the client is late to the appointment time, the client’s session will still be for the same scheduled ending time and may result in less images being captured. If client is a no-show or their time of photo session runs out the payment will still be due in full.
*Please make sure hair is combed and face is clean and free of runny noses or eyes.
*Please avoid eating or drinking red, orange, or heavily dyed food or drinks before session, as these tend to leave a stain on the face.
EXTRA INFO:
• Wear neutral/earthy toned colors. -For example: white, grey, navy or light blue, beige, browns, light pink , etc. These colors allow the images to become more timeless and that is the style that I aim to capture! I always love when accessories are added to the photoshoot. For example, a felt or straw hat, some jewelry, etc.
• You are more than welcome to bring props for your photoshoot! Especially if they're meaningful to you.
For example: balloons, blanket to sit on, chair, or anything else that you feel will go along with your session!
